New York Attorney General Letitia James’ Office of Special Investigation will not pursue criminal charges against Upstate New York police officers who shot and killed James Cushman on Aug. 30, 2024, according to a report released Wednesday.
The investigation concluded that a prosecutor would not be able to disprove beyond a reasonable doubt at trial that the officers’ use of deadly force was justified under New York law.
Cushman called 911 at 8:52 p.m. that evening to report a disturbance at his home in Orchard Park, Erie County, involving a gun. He told dispatchers he was armed with a knife to defend himself…
