A Florida Man Wore a Bulletproof Vest When He Shot a Police Officer Three Times in 2011. His Retrial Starts Tuesday

The man’s life sentence was overturned in 2017

A new trial for a man in Florida who allegedly shot a police officer after being pulled over a decade ago is set to begin this week.

In 2011, Yousel Revera was pulled over by Cape Coral Police Officer David Wagoner for a traffic stop. When Wagoner walked up to the vehicle’s passenger side to request identification, Revera allegedly shot him three times.

Revera was convicted of attempted first-degree murder of a law enforcement officer with a firearm and received a life sentence in 2013, according to the Fort Myers News-Press .

However, in 2017, a three-judge panel of the 2nd District Court of Appeal overturned the conviction because the judge failed to explain to the jury whether the defendant knew the victim was a police officer.

Wagoner survived the gunshots, as he was wearing a bulletproof vest when he was shot. He has since retired from the police department.

The retrial was delayed several years but is now scheduled to begin on Jan. 23 at the Downtown Fort Myers courthouse.
