Indiana Gov. Mike Braun announces end to ‘race- and sex-based contracting preferences’

INDIANAPOLIS — Indiana Gov. Mike Braun has announced Indiana will end “race- and-sex-based contracting preferences.”

The announcement comes after a legal opinion from Indiana Attorney General Todd Rokita, which found race-and-sex-based contracting preferences within the Minority and Women’s Business Enterprises to be unconstitutional under the Equal Protection Clause of the Fourteenth Amendment, according to Rokita’s office. Those components are part of Indiana’s broader Diversity Business Enterprises and Division of Supplier Diversity.

Braun said instead, Indiana will use a “a merit-based approach that gives every Hoosier business a fair opportunity to compete.”…
