Developer sues Zebulon after town blocks proposed asphalt plant near Nomaco Park

The company behind a proposed asphalt plant in Zebulon has filed suit asking a Wake County judge to overturn the town’s decision denying the project and order that the permit be approved.

East Wake LLC filed a petition for judicial review Wednesday in Wake County Superior Court, appealing the Zebulon Board of Commissioners’ unanimous vote in May to deny a special use permit for an asphalt plant on a 17.6-acre portion of a roughly 30-acre property at 1444 Old U.S. 264 Highway near Nomaco Park.
