Only on 10: Charge dismissed with prejudice for man arrested for wearing mask in public

NORFOLK, Va. (WAVY) — As 10 On Your Side first reported, a felony charge of wearing a mask in public has been dropped against a Norfolk man.

Only 10 On Your Side was in the Norfolk courtroom when Jorge Miguel Diaz Jr., 29, appeared before the judge for a hearing that took less than a minute.

The judge ruled, on advice from Norfolk Commonwealth’s Attorney Ramin Fatehi, that the charge is dismissed with prejudice, meaning the felony charge cannot be brought back.

“Ultimately, the judge said the matter is dismissed with prejudice, and cannot be brought back under any circumstance,” said Diaz’s attorney, Herman Smith…
