Prosecutors: He walked away from a fight — then returned to commit murder

A 20-year-old man who had already walked away from a sidewalk scuffle in Austin returned moments later and fatally shot the man who had fought him, prosecutors said.

Donnell Wyatt is charged with first-degree murder in the July 12 shooting of 53-year-old Jeffrey Hicks outside their shared apartment building in the 5600 block of West Division Street. Surveillance footage captured the entire confrontation and shooting, prosecutors said in a detention petition.

According to Assistant State’s Attorney Mike Pekara, Wyatt and Hicks had a brief verbal dispute earlier in the evening in front of the building, which also houses a clothing store with exterior security cameras. Hicks allegedly called Wyatt a “b****” during the exchange, and Wyatt walked off.

About 20 minutes later, Wyatt returned, and another argument broke out. Hicks grabbed Wyatt by the neck, shoving him into the building entrance, Pekara said. The two struggled and fell to the sidewalk, where Wyatt eventually got free and began running away westbound, with what Pekara described as “a clear path of escape.”…
