4 years for man whose accomplice was killed during a botched robbery at Gresham gas station

A 21-year-old man who was on electronic monitoring for a gun case when his accomplice was killed during a failed robbery attempt at a South Side gas station has been sentenced to four years in prison.

Judge Stanley Sacks handed down the sentence to Tommery Moore, who received three years for aggravated battery in a public place and an additional consecutive year for a separate felony gun case. Moore was wearing an electronic ankle monitor for that earlier case when the fatal encounter occurred.

According to a Chicago police report, surveillance video captured the events that unfolded around 11:15 a.m. on August 28, 2024, inside Falcon Fuel at 7600 South Halsted Street. The footage showed the 37-year-old victim using an ATM when Moore and his accomplice, 37-year-old Toron Davis, approached and began talking with him. Moments later, Davis was seen removing items from the man’s pockets, police said.

When Davis allegedly grabbed the victim by his dreadlocks and tried to force him outside, the victim fought back, pulling out a knife and slicing Davis’ neck.
