Chicago judge pauses DHS suit dismissal, citing fatal ICE shooting

CHICAGO (NewsNation) — A federal judge in Chicago cited the recent fatal shooting of a 37-year-old woman by an immigration officer in Minneapolis in her reasoning to not immediately dismiss a lawsuit filed against the Department of Homeland Security.

Judge Sara Ellis said in a hearing Thursday she wants more time to conduct research before ruling, after a group of journalists, protesters and clergy filed a motion to dismiss the case. The motion to dismiss was made largely for strategic reasons to preserve the previous rulings in the case.

Ellis was expected to dismiss the lawsuit, but said the fatal shooting of Renee Nicole Macklin Good by an Immigration and Customs Enforcement officer on Wednesday gave her pause. The federal lawsuit included DHS Secretary Kristi Noem, Border Patrol commander Gregory Bovino and other federal officials as defendants.
