CINCINNATI (WXIX) – A federal lawsuit will proceed against the city of Cincinnati, Police Chief Teresa Theetge and the veteran captain she fired, newly filed court records show.
U.S. District Court Judge Matthew McFarland dismissed half of the eight claims in Officer Toni Nash’s October 2024 suit.
He believes, however, there’s enough merit in these four to warrant further legal proceedings with discovery, including depositions:
- Race discrimination
- Deprivation of rights against Cincinnat
- Deprivation of rights claim against the chief and captain
- Conspiracy to violate civil rights
The claims dismissed:
- Hostile work environment
- Retaliation
- Deprivation of rights against the captain and chief
- Neglect to prevent conspiracy to violate civil rights claims
FOX19 NOW sought comment from the city, police department and attorneys for Nash and ex-Captain Danita Pettis.
