Convicted murderer has hearing to determine if he will face the death penalty

PINELLAS COUNTY, Fla., (WFLA) — On Tuesday, a psychiatrist was called to testify at the Spencer hearing for Shelby Nealy.

A Spencer hearing is given to anyone facing the death penalty, and is where their defense team presents evidence or challenges the sentencing, to allow the judge to consider outside factors besides the jury’s death penalty recommendation.

Nealy has been convicted of killing four people. He sat in court as his defense team presented evidence to try and prevent him from getting the death penalty, which a jury recommended earlier this year…
