Student’s lawsuit over falling ceiling tile in Cleveland gym class advances

CLEVELAND, Ohio — An appeals court has ruled that Cleveland Metropolitan School District cannot automatically claim legal immunity in a lawsuit over a ceiling tile that fell on a student during gym class.

The Wednesday decision by the 8th Ohio District Court of Appeals likely means a Cuyahoga County jury will decide whether the district and a substitute teacher were negligent in allowing volleyball to be played in a room where ceiling tiles were known to fall.
