The Cherokee County Board of Commissioners has scheduled a Jan. 20 public hearing to discuss a board-initiated proposal to rezone about 60 acres in the historic Pearidge Community from R-40 to a less restrictive R-20 classification.
The commissioners’ action comes after Pearidge Land Investments, LLC, and its partner, Nickel Creek Development, LLC, filed suit in Cherokee County Superior Court challenging the county’s denial in August of a request to rezone the property to RD-3. An RD-3 classification would allow three housing units per acre. The county-proposed R-20 would allow a little over two units per acre.
The developers’ suit alleges that denial of the rezoning request deprives Pearidge of economically viable use of the property, and that their proposal was aligned with the county’s Comprehensive Plan. Court action is pending on the suit and on a county motion for dismissal, filed Dec. 12.
