A man accused of firing gunshots at a burrito restaurant in Broomfield on July 8, 2023, has been deemed incompetent, so the charges he faces are expected to be dismissed, according to court records.
Kenneth Fairchild, 45, was deemed incompetent to stand trial on June 10 in Broomfield County District Court. A mental health evaluation determined that he was unable to be restored to competency, which would have allowed him to stand trial.
County Court Judge Amanda DeWick ordered Fairchild civilly committed for mental health treatment and not released back into the community. He has been held at Colorado Mental Health Hospital in Pueblo since he was sent there for a competency review on July 20, 2023.
