Duke hospitals among larger group suing federal government over Medicare underpayment claims

Duke University Health System believes it deserves more money from Medicare, the federal program that provides health insurance to the elderly and those with disabilities.

The system’s hospitals are currently involved in two lawsuits against Robert F. Kennedy Jr. in his capacity as secretary of the Department of Health and Human Services. The lawsuits, which were filed alongside hospitals from around the country, allege that HHS improperly calculated two key measures for reimbursing hospitals, leading to lower payments than legally required. One of the lawsuits was filed in October 2025, and the other was filed this May.
