El Paso Walmart gunman’s attorneys claim DA withholding evidence on gunman’s mental health

Allegations of wrongdoing continue to mount in the long-delayed El Paso Walmart mass shooter case as defense attorneys say state prosecutors withheld “mitigating” evidence on the gunman’s mental health, court documents show.

Attorneys for gunman, 26-year-old Patrick Crusius , say they recently discovered the El Paso County District Attorney’s Office did not turn over evidence that included interviews the office conducted with two of the gunman’s former Allen, Texas neighbors. Those interviews found the gunman struggled with mental health problems since he was a child.

A motion regarding the withholding of that evidence was filed Monday, Sept. 30, by defense attorneys.

The motion is the first publicly available court document to discuss the mental health issues allegedly suffered by the gunman. In federal court, the gunman’s mental health issues were discussed during his July 7, 2023 sentencing hearing, including defense attorneys claiming the gunman suffered from schizoaffective disorder.
