Court grants appeal in death penalty case of convicted El Paso ‘Desert Killer’ David Wood

Texas’ highest appeals court remanded David Leonard Wood’s serial killer death penalty case back to a trial court in a divided decision between the justices.

The Texas Court of Criminal Appeals ruled Wednesday, July 31, that the capital murder case against Wood, now 68, should be reexamined by a trial court over allegations by Wood’s attorneys of constitutional violations against their client, the ruling states. The ruling will cause years of delays in a case that has been pending since the late 1980s.

The ruling does not order a new trial be held for the so-called “Desert Killer.” It is vague, however, on establishing what the justices want the trial court to review…
