El Paso, TX (KFOX14/CBS4) — In this week’s segment of “Legal Jargon,” attorney Daniela Labinoti addressed a common post-breakup dilemma: the handling of personal property. Labinoti explained that individuals have the right to their personal belongings, even if they live with a partner. “No one can just destroy your personal property,” she said. “You can sue someone for damages for destroying your personal property.”
Labinoti also clarified that if an item is jointly owned, such as a bed, it cannot be destroyed. “Cutting the property in half is not okay,” she said. “It’s destruction, and you can be sued for that.”
The discussion also touched on gifts. If an item was given as a gift, it belongs to the recipient, even after a breakup.
