HENDERSON, Ky. (WEHT) – The National Right to Work Foundation has announced that Brian Head of Evansville has won a settlement against a local electrician’s union that reportedly threatened to fine him $1.29 million in disciplinary fines after he resigned his membership.
Head filed federal charges against the International Brotherhood of Electrical Workers Local 16 union after he claimed union officials retaliated against him after he resigned his union membership and announced he would be purchasing a non-union electrical firm. Head claimed in the lawsuit that he resigned his IBEW union membership on March 27, 2025, and his letter of resignation was received and acknowledged by union officials. However, in a reply letter, union officials claimed it would be six-months before his resignation was effective. On June 9, a letter from IBEW Local 16 officials threatened to impose a $1.29 million fine against Head.
A National Labor Relation’s Board Regional Director determined that union officials violated Head’s rights under the National Labor Relations Act, which forbids restricting the right of workers to resign their union memberships and prevents union leaders from imposing discipline or fines upon nonmember workers.
