Judge permanently shuts down 708 Bar & Grille, orders licenses surrendered within 48 hours

HUNTSVILLE, Ala. — A Madison County circuit judge has permanently closed 708 Bar & Grille, issuing a final judgment and permanent injunction against the Poplar Avenue establishment after finding it a public nuisance and persistent zoning violator.

Circuit Judge Ruth Ann Hall signed the order on Thursday, days after hearing arguments on the City of Huntsville’s motion for summary judgment. The ruling came after the defendants — 708 Bar & Grille, LLC, Genell Hughes, Malcolm Gopher, Catherine Gopher and Illiyha Gopher — repeatedly failed to respond to discovery requests and court orders.

The order declares that the bar’s operation at 708 Poplar Avenue is “violative of the City of Huntsville’s Zoning Ordinance and constitutes a public nuisance injurious to the health, morals, comfort, and welfare of the neighborhood in which it is situated.”…
