TURNER COUNTY JUDGE RULES IN FAVOR OF DAKOTA PROTEIN SOLUTIONS

A Turner County judge has ruled in favor of Dakota Protein Solutions (DPS) in a matter concerning additional conditions imposed by the Turner County Board of Adjustment last fall.

In his six-page ruling issued June 3, First Circuit Court Judge Chris S. Giles concluded that the board “failed to provide notice and a right to respond in violation of Dakota Protein Solution, LLC’s due process rights, as well as imposing unauthorized conditions on Dakota Protein Solutions, LLC, under Turner County Ordinance 20.12.”

The ruling came 14 weeks after Giles heard the case brought to the court by DPS in response to a series of conditions added to the original conditional use permit issued by the Turner County Board of Adjustment in October of 2021…
