A Boston assisted living facility failed to check on a resident for nine days despite 27 missed meals and no movement detected in his room during that entire period. Felipe Dip, 64, was found dead in his room at Chestnut Park at Cleveland Circle in Brighton on July 21, 2023 — his body badly decomposed.
His sons, Ricardo Dip Calimano and Benjamin Dip Gerber, are suing the facility’s parent company, Benchmark Senior Living, and an unidentified employee assigned to look after their father for negligence, wrongful death, and negligent infliction of emotional distress. The lawsuit seeks all damages available under Massachusetts law.
“Felipe Dip’s body had been decomposing in his room, undiscovered, for approximately nine days,” the complaint states, according to Law&Crime. The last time a motion-sensing camera detected movement in Dip’s room was July 12, 2023 — nine days before his body was discovered.
Facility protocol required welfare checks for any missed meal, but none were conducted
The facility’s own protocol required staff to conduct a welfare check on any resident who failed to appear for a scheduled meal, the suit states. “The combination of Felipe Dip’s prolonged and repeated failure to appear for meals and the nine-day absence of any motion in his room provided the Defendants with ample and repeated notice that Felipe Dip required immediate attention,” the complaint states…
