ROSWELL, N.M. (KAMR/KCIT) – A former security employee with Eastern New Mexico University’s Roswell campus filed a lawsuit against multiple university officials in June, which argues he was unfairly forced to resign in September 2025 after making a negative post on social media regarding the death of Charlie Kirk, a conservative commentator and co-founder of Turning Point USA.
Oswaldo Nava’s legal team filed the lawsuit on June 24 against multiple ENMU officials in their individual capacities, including:
- ENMU-Roswell President Shawn Powell
- ENMU President/Chancellor James Johnston
- ENMU Vice President of Administration and Finance W. Anthony Major, Jr.
- ENMU Executive Director of Human Resources Benito Gonzales
- ENMU-Roswell Executive Director of Human Resources Stephanie Miles
- ENMU-Roswell Director of Marketing and Public Relations Martha Staab
- ENMU-Roswell Interim Vice President of Academic and Student Affairs Eric Mann
According to Nava’s lawsuit, Nava worked with ENMU-Roswell as a security employee from 2019 through September 2025, with “good job performance evaluations” and “no disciplinary action of any sort” during his employment.

On Sept. 10, 2025, Kirk was shot and killed while speaking at an event at Utah Valley University. On Sept. 13, 2025, according to the lawsuit, Nava posted a statement on his personal Facebook page reading: “I woke up today and guess who didn’t??? Charlie Kirk, lol.”
The lawsuit said Nava was identified by conservative influencer Scott Presler online, who allegedly posted Nava’s cellphone number and email address, noting Nava as an employee of a public institution who had made a negative comment in relation to Kirk. The lawsuit said Nava received “harassment and threats” after his information was posted, and that “numerous persons” began to pressure ENMU-Roswell officials to fire him…
