Kentucky man gets 40 years behind bars for fatal crash that killed 10-year-old during chaotic police chase

A judge has sentenced Kentucky’s Tymetrius Walter to four decades behind bars for killing a 10-year-old boy with a stolen car after the police attempted a traffic stop. The incident happened on September 16, 2023, when a Kentucky State Police trooper tried to stop the car traveling south on Interstate 71 near the 21-mile marker in Oldham County, per an official release. The vehicle did not stop and was then pursued by KSP Post 5 dispatch. During the chase, the accused rammed his vehicle into a white GMC SUV, which carried the victim and was traveling north on KY 329.

The accused’s plea agreement led to the removal of the murder charge

Walter, who pleaded guilty to receiving stolen property over $10000 and fleeing police last month, entered into a plea deal with prosecutors that took his murder charge down to vehicular homicide. On Wednesday, July 1, a judge sentenced the accused to 40 years in prison, per WHAS11.

During the sentencing, the family member of the victim, identified as 10-year-old Jake Luxemburger, read their victim impact statement. The kid’s mother, Kathryn Luxemburger, said that the kid was a baseball fan and was going shopping for his birthday.

“He loved his family, his friends and life itself. The morning he died, he was so excited because he was going shopping for his birthday. You made the choice to run from the police. You chose to put your own desire to avoid being caught above every life around you,” the mother said, per the outlet.

The accused apologized to the victim’s family

Even though the judge sentenced Walter to a 40-year sentence, an emotional Kathryn stated that the accused gets to walk free one day, but her son did not get an opportunity to live. “When your sentence is complete, you will walk out of prison, you will have the opportunities to rebuild your life. Jake will never get that opportunity. His sentence is permanent and our sentence is permanent,” she said, per the outlet…
