BAKERSFIELD, Calif. (KGET) — A state appeals court has denied a petition to overturn Zack Scrivner’s granted mental health diversion.Scrivner was granted the diversion eight months ago.
The state Attorney General’s office never charged Scrivner with a sex crime, even though it alleges he molested his pre-teen daughter. If Scrivner had been charged with a sex crime, he would not have been eligible for diversion.
Instead, the Attorney General’s office sought to appeal the granting of diversion in the 5th District Court of Appeals. That petition was denied, and with every legal path used, he is set to finish the mental health diversion and his case would essentially disappear from court records forever…
