No ruling yet, but Smithfield lawsuit has more time for new arguments

A lawsuit filed last April by dozens of residents who live near the newly proposed Smithfield Foods pork plant near Crooks has a few more weeks to meet its fate.

On Monday, Aug. 3, Minnehaha County’s Second Circuit Court Judge Ann Hoffman presided over a second hearing in the case after a request to move the case to a higher court was denied last month.

The plaintiffs now have until Aug. 18 to submit additional briefings on a lawsuit accusing the Sioux Falls City Council of rushing to approve a conditional use permit and a $90 million tax increment financing district that would support future construction of the $1.3 billion facility…
