Pomykala and her 14-year-old lived at the apartments located at 19733 River Road in Gladstone on May 3 when the child reportedly sat on the windowsill inside her bedroom on the third floor. She fell backward through the screen and onto the ground below.

The teen suffered life-threatening injuries as a result of the fall, according to the complaint. She fractured her forehead, the bones around her eye, her nasal bone and her sinus. She also suffered a traumatic brain injury, including a subarachnoid hemorrhage, gas trapped inside the skull, headaches, balance issues, neck pain and more.
