GAINESVILLE, Ga. — Defense attorneys for Jessica Maria Motes appeared in Hall County Superior Court late last week, arguing to throw out the capital murder indictment against her.
Representing the 36-year-old defendant, lead counsel argued before Superior Court Judge Lindsay H. Burton that the state’s indictment is “woefully inadequate” and lacks the required specificity for a case in which prosecutors are seeking the death penalty. According to filings, defense attorneys filed a special demurrer (challenge) contending the charges are too vague and ambiguous to allow Motes to properly build her defense.
In addition to challenging the phrasing of the indictment, defense counsel mounted a challenge against the composition of the grand jury list, filing motions to access master jury pool records to audit whether the grand jury was compiled in accordance with statutory standards.
