Court records described a morning incident near the Poteet Jourdanton Freeway. At about 7:20 a.m. on July 10, Mario Rosalio Avila, 28, allegedly parked a gray SUV at his sister’s house next door to the home with the dogs, then walked over carrying a rifle.
The arrest affidavit says the two dogs were in their owner’s yard when Avila approached. After telling them to “shut up,” he allegedly fired and killed one dog, then walked back to his SUV and drove away.
