Illinois Attorney General Kwame Raoul has filed a lawsuit against ABC Plumbing, Heating, Cooling & Electric Inc., accusing the Arlington Heights-based company of misleading customers, most often senior citizens, into signing home-repair contracts at inflated prices for work that was often sloppy, incomplete, or entirely unnecessary. The suit alleges technicians used digital tablets to get customers to sign paperwork without letting them read what they were agreeing to, and that some of the work was performed by unlicensed technicians.
According to a report from CBS News, Raoul said ABC Plumbing’s practices specifically targeted senior citizens seeking urgent work, often after they called for what they believed was a simple repair. The lawsuit alleges technicians inspected additional areas of consumers’ homes without permission, then described whatever they found as an emergency or a life-threatening hazard that had to be fixed immediately. Company technicians also allegedly completed work that was overpriced and often unnecessary, according to the outlet’s report. ABC Plumbing, headquartered at 220 W. Campus Drive in Arlington Heights, provides residential plumbing, sewer, heating, cooling, and electrical services across the Chicago metropolitan area, per Patch.
Contracts Signed Without a Chance to Read Them
The lawsuit accuses ABC Plumbing of violating the Illinois Consumer Fraud Act, the Deceptive Trade Practices Act, and the Home Repair and Remodeling Act. Central to the complaint is the allegation that customers signed on digital tablets to initiate work without being allowed to read what they were signing, and that the contracts included language waiving consumers’ standard three-day right to cancel — meaning some customers unknowingly waived their ability to back out of a deal even after consumers tried to cancel their ABC Plumbing contracts.
That waiver matters more for older homeowners than most. Under Section 22 of the Illinois Home Repair and Remodeling Act, seniors aged 65 and older who purchase home repairs from an uninvited solicitor are entitled to a full 15 business days to cancel a contract, not the standard three days given to other consumers. Separately, the law requires contractors performing work valued over $1,000 to hand homeowners an official Home Repair: Know Your Consumer Rights pamphlet before any contract is signed, per Illinois State Bar Association guidance on the statute.
Unlicensed Work and Steep Financial Exposure
The state’s complaint also alleges ABC Plumbing used unlicensed technicians for some home repairs.
