Lee Gilley, who is accused of killing his wife and unborn child, fled to Italy after posting the bond amount and the Italian government denied his extradition if he faces a death sentence or life in prison without parole.
This has led the Texas prosecutors to file official notice not to seek the death penalty for the perpetrator.
The medical examiner determined the cause of death as strangulation
