Ohio’s plan to strip sugary drinks and all fountain drinks from food-stamp purchases missed its original October 1 start after federal regulators asked the state to slow down, and the U.S. Department of Agriculture’s own waiver table, updated September 25, 2026, now lists a firm replacement date: November 1. The delay was not a retreat from the restriction itself, since Ohio’s underlying waiver remains approved, but a federally requested pause for public comment that pushed the calendar back a full month. Ohio now shares that November 1 date with four other states moving on the identical week, part of an 18-state list of active waivers the USDA has approved since states first began seeking permission to limit what SNAP benefits can buy.
A federally requested pause, then a new date
Ohio Department of Job and Family Services Director Matt Damschroder announced the delay on September 4, 2026, saying the state agreed to postpone the October 1 launch after the USDA’s Food and Nutrition Administration asked for time to publish a formal notice in the Federal Register and review public comments before the restriction took effect. Damschroder’s announcement did not name a replacement date at the time, saying only that further updates on implementation would follow.
That replacement date arrived through the USDA’s own bookkeeping rather than a second Ohio announcement. The agency’s food-restriction waiver table, last updated September 25, 2026, lists Ohio’s implementation date as November 1, 2026, three weeks after Damschroder’s delay notice and a full month past the state’s original target.
The restriction traces back further than this year’s scheduling dispute. Ohio Gov. Mike DeWine convened a working group in June 2025 to study limiting soda and candy purchases under SNAP, the process that produced the waiver application the USDA ultimately approved for a restriction covering sugar-sweetened beverages and all fountain drinks specifically, a narrower category than the candy-and-snack restrictions some other states have adopted. That narrower scope means an Ohio SNAP card will still work at a soda fountain for an unsweetened option or at a checkout line for a candy bar, even after November 1, since neither item falls inside the two categories the state’s waiver actually names…
