Longmont officers cannot be liable for false arrest, judge rules

Two Longmont police officers who arrested a man without probable cause of intoxication cannot be held liable for their constitutional violation, a federal judge ruled last month.

Justin Stoeber returned home after a wedding in October 2023, where he had consumed some alcohol. He woke up after midnight and went into his backyard to smoke. Stoeber saw two men crouched in the shadows of an alley and he confronted them. One person pointed a gun at him, which caused Stoeber to fear for his life.

Stoeber went inside and called 911, but he also grabbed his own gun and walked through the neighborhood for around 10 minutes to look for the men…
