MOBILE, Ala. (WALA) – A Mobile County judge’s ruling Monday cleared the way for the start of a rape trial.
Morris Linson Jr. is accused of abducting an 18-year-old woman from outside Troubadours Country Saloon in 2021, sexually assaulting her and then dumping her in a parking lot at the University of South Alabama. Prosecutors allege that the victim was too intoxicated to consent.
Linson’s attorney, Megan Allgood, argued that key evidence should be thrown out. She said Mobile police never read her client his Miranda rights when they went to his home in Pensacola to question him.
Prosecutors argued that it was not necessary to tell Linson that he had a right to remain silent because he had not been arrested and was not detained. But Allgood said it is clear that Linson wasn’t free to leave…
