ALBANY — An appeals court sided Thursday with a state Department of Motor Vehicles worker who had his guns taken away by police after he displayed them in a videoconference with staff from the department who were investigating his travel reports.
The Appellate Division of state Supreme Court rejected most of the arguments put forward by the worker, a Connecticut man named in the ruling as Brian LL, but found that State Police did not “establish by clear and convincing evidence that (the man) was likely to engage in conduct that would result in serious harm to others.”
DMV officials reported the man to the State Police in January 2025 after a pistol and rifle were “prominently displayed” behind him on the second day of virtual meetings between the worker and department representatives, the decision said.
