According to the Schenectady County District Attorney’s Office, on January 29, 2022, Cherry and Alston followed one of the victims of the home invasion into Central Park and robbed her at gunpoint. Hours later, police pulled over a car driven by Radames Moya, a fourth codefendant in the case.

Police say they found two loaded handguns in the car. While on bail, the Schenectady County District Attorney’s Office says Alston was arrested and extradited from Virginia, where he is originally from. When he was apprehended, officials say he possessed a fully automatic handgun.
