CANTON ‒ A man is suing the Alliance city government and two of its police officers, alleging they committed assault, battery and violated his constitutional rights on two traffic stops.
The civil complaint was filed Feb. 5 in Stark County Common Pleas Court by attorneys Julie and Jeffrey Jakmides on behalf of Mario C. Zachery, a 43-year-old Alliance resident. It asks for more than $1 million.
Alliance Law Director Caitlyn Weyer said she does not comment on pending litigation.
The lawsuit says that officers Robert J. Toussant and Christian A. Tussey pulled over Zachery for “claimed traffic infractions” on Feb. 5, 2023, and April 15, 2023, respectively. Juries acquitted Zachery of the resulting criminal charges.
Zachery’s complaint says he suffered physical and emotional injuries from the officers’ use of “excessive and unreasonable force.” It says Zachery did not resist or obstruct police in either incident.
