Lee County deputy who crashed in Cape Coral ditch sentenced to 12 months of probation

A Lee County deputy charged with DUI after his involvement in a single-car crash entered a plea Tuesday, Feb. 13 and was sentenced to one year of probation.

Samantha Syoen, spokesperson for the State Attorney’s Office, 20th Judicial Circuit, said Roberto Fabela, 51, pleaded guilty to willful wanton reckless driving with alcohol as a significant factor.

In addition to the 12 months of probation, Syoen said, Fabela received a $500 fine and his license was restricted to business purposes only for six months.

As part of the sentence, Fabela must also do 50 community service hours, attend DUI school and may not possess or consume alcohol while on probation. He is also subject to random alcohol and chemical testing and must attend a Victim Impact Panel, Syoen said.

The court withheld adjudication following an argument by his counsel, Syoen said.

According to an incident report from Cape Coral Police, shortly after 3 a.m. July 25, officers were dispatched to a wreck the 1700 block of Southwest Pine Island Road.
