DA: Police were legally justified in fatally shooting man near City Park in July

District Attorney Gordon McLaughlin released a letter Friday stating that four police officers were legally justified in their use of force during a July shootout that took place in the Grandview Cemetery near City Park.

McLaughlin’s conclusion came after a multi-agency investigation by the Critical Incident Response Team . No criminal charges will be filed.

The letter also provides additional details about the incident that day and the names of the officers involved — Officer Peter Nolan, Sgt. Brian Mallory, Officer August Barber and Officer Cole Giandomenico.

The incident occurred after Fort Collins police officers responded to a car crash at Mountain and Bryan Avenues on July 21. Upon arrival, witnesses informed them an adult male driver had exited the vehicle armed with a gun.

The man, later identified as 42-year-old Clayton Pierce, and the police would go on to exchange gunfire. Pierce eventually died from gunshot wounds.

Letter includes new details of cemetery shootout

In the month since the shooting, few details were known about what happened that day. The district attorney’s letter provided an overview based on officer interviews, body worn camera footage and a toxicology report.
