Horry County Police Department seeks dismissal of lawsuit tied to June beach death

HORRY COUNTY, S.C. (WBTW) — An Horry County police officer behind the wheel of a full-sized vehicle that struck and killed a beachgoer in June is not to blame for her death, the department’s attorneys said in court records.

Lawyers on Wednesday responded to a June 28 wrongful death suit filed by the family of Sandra Schultz-Peters, a 66-year-old Myrtle Beach woman who died June 13 after being hit near the Nash Street beach access.

The 12-page complaint named the police department as the lone defendant, claiming her death was the result of lax supervision and negligence.

In their Aug. 21 response, Hood Law firm attorneys Elloree A. Gaines and Evan M. Sobocinski denied key allegations lodged against the department and Duke Brown, its now-retired beach patrol safety supervisor who was driving the vehicle.

They’re asking a judge to dismiss the suit “with prejudice” and award the police department the cost of legal fees associated with the case.
