Workers’ Compensation Court of Appeals Digest: Sept. 25, 2024

Employer and insurer appealed from the compensation judge’s determination of the employee’s weekly wage, arguing that application of the statute produced a weekly wage that does not accurately reflect the employee’s earning capacity and creates an unreasonable outcome. Noting that whether the result was fair and reasonable was a question for the legislature, not for this court, the Workers’ Compensation Court of Appeals concluded that the compensation judge accurately determined the employee’s weekly wage for a seasonal worker under Minn. Stat. § 176.011, subd. 8a. Affirmed.
