Judge hears arguments for a new trial or dismissal for armorer in fatal shooting on set of ‘Rust’

SANTA FE, N.M. (KRQE) – In a hearing Thursday, Hannah Gutierrez looked to get a new trial or have her case dismissed.

Defense on Thursday called the states conduct egregious and said they hid evidence that could have changed the outcome of Gutierrez’s trial, while the state denied those claims.

“The Teske evidence wasn’t deliberately hidden from Mr. Bowles. It was provided to him by his own witness. He could have had it tested at any point in time,” said Prosecutor Kari Morrissey.

In 2021, Actor Alec Baldwin was holding a gun that went off with a live round in it on the set of Rust, hitting and killing cinematographer Halyna Hutchins. His case was dismissed in July because the judge said prosecution failed to disclose evidence.

Gutierrez is serving an 18-month sentence for involuntary manslaughter in the fatal shooting of cinematographer Halyna Hutchins on the movie set of “Rust” in 2021. Earlier this year, Gutierrez’s attorney filed a motion asking for a new trial in her case or to have it dismissed.
