Perkins family lawyers challenge tow company’s arbitration request in wrongful death lawsuit

DECATUR, Ala. (WHNT) — Attorneys representing Stephen Perkins’ family have filed a response in the lawsuit against the tow truck company involved in his case. The tow company and its employees are named as defendants in a wrongful death lawsuit regarding Perkins’ death.

The tow company, Allstar Recovery, LLC, is asking to solve the dispute outside of court. But Perkins family lawyers argue this matter needs a judge and possibly a jury.

A federal judge has dismissed several claims in the lawsuit including those filed against three former Decatur police officers, and the City of Decatur over the police shooting death of Stephen Perkins.

The court said it would allow a civil rights violation claim to move forward against Mac Bailey Marquette, who is also charged with murder in Perkins’ death.

Allstar Recovery’s status has not been resolved by the court. The tow company and two employees say they want the claims against them handled by an arbitrator.
