DA Seeks Clemency for Menendez Brothers

Los Angeles District Attorney George Gascón is backing the Menendez brothers’ request for clemency from Governor Gavin Newsom.

The brothers, Lyle and Erik, were sentenced to life without parole for murdering their parents in 1989. However, Gascón is recommending their sentences be reduced to 50 years to life, making them eligible for immediate parole.

In addition to clemency, the brothers have two other potential routes to freedom. They can petition for resentencing, which would remove the “without parole” portion of their sentence. Alternatively, they can pursue a habeas corpus petition based on new evidence, such as allegations of sexual abuse by their father.

The District Attorney’s office is open to considering a reduced conviction based on the new evidence. The brothers’ fate now rests in the hands of a Superior Court judge, a parole board, and potentially, the courts reviewing their habeas corpus petition.
