Lawsuit challenging Alabama High School Athletic Association transfer rule dismissed

A lawsuit challenging the Alabama High School Athletic Association has been dismissed.

Montgomery County Circuit Court Judge J.R. Gaines ruled Thursday to dismiss the lawsuit brought by Michael Kidd on behalf of his son. The lawsuit challenged the AHSAA’s transfer eligibility policy. Kidd’s son, a 10th-grader, had transferred from Prattville High School to Marbury High School, using the Autauga County Board of Education’s school choice policy. He was trying to circumvent the bona fide move rule as the family did not move to make the change.

Kidd’s son played varsity football and baseball at Prattville and was looking to continue play at that level after his transfer to Marbury. Kidd’s son was ruled ineligible by the ASHSAA.

Gaines had already denied a preliminary injunction to allow Kidd’s son to be immediately eligible by pausing the transfer rule earlier in October. The AHSAA filed a motion to dismiss, which was granted on Wednesday.

“We are very pleased with the Court’s decision and appreciate its careful review of the facts and law,” AHSAA Executive Director Heath Harmon said.
