Newsom Denies Menendez Brothers Parole

Governor Gavin Newsom has decided to hold off on making a decision about clemency for Erik and Joseph “Lyle” Menendez. He will wait until newly elected Los Angeles District Attorney Nathan Hochman has had time to review the case.

Hochman has stated that he will not make a decision until he has thoroughly familiarized himself with all aspects of the case, including confidential prison files, trial transcripts, and speaking with various parties involved.

The Menendez brothers’ resentencing hearing is scheduled for December 11th. Hochman has indicated that he will thoroughly review the case and will take the same approach he does with all cases, regardless of media attention.

If Hochman’s office continues the resentencing process, Newsom will ultimately have the final say. He could reduce the brothers’ sentences, veto parole board decisions, or issue clemency or a pardon himself.

A separate habeas corpus petition, based on new evidence of child abuse, is also ongoing. If successful, this could provide an additional path to freedom for the brothers.
