Florida gun shop owner pleads guilty to selling firearms off the books

MIAMI, Florida ( MyFloridaNews ) — Michael John Pellicione, a 76-year-old gun shop owner from Port St. Lucie, Florida, has pleaded guilty to a five-count indictment for selling firearms without proper record-keeping. Pellicione faces up to five years in prison for violating federal law, according to a press release from the U.S. Attorney’s Office for the Southern District of Florida.

Pellicione, a federal firearms licensee (FFL), failed to record the sale of five firearms in his acquisition and disposition (A&D) record, a requirement under 18 U.S.C. § 922(b)(5). The law mandates that FFLs document all firearms received or sold, including details such as type, make, model, caliber, serial number, and the buyer’s information.

The case was investigated by Homeland Security Investigations (HSI) Fort Pierce and the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) Fort Pierce. Markenzy Lapointe, U.S. Attorney for the Southern District of Florida, announced the guilty plea alongside Special Agent in Charge Anthony Salisbury of HSI Miami and Special Agent in Charge Christopher A. Robinson of the ATF Miami Field Division.
