Windsor hotel shooting suspect found legally competent in attempted murder case

The criminal case against a man accused of shooting at first responders from on top of a fire truck at a Windsor hotel last January will continue moving forward now that a judge has ruled him legally competent.

Damian Jackson, 40, was arrested last January after investigators say he pulled the fire alarm at the AmericInn at Wyndham at the southeast corner of Interstate 25 and Colorado Highway 392 to draw a law enforcement response and then shot at first responders and civilians from the top of a fire truck.

Law enforcement officers exchanged gunfire with Jackson, but no one was injured.

Jackson has been charged with five counts of attempted murder, a Class 2 felony; three counts of first-degree assault, a Class 3 felony; five counts of menacing, a Class 5 felony; false reporting, obstruction of justice, reckless endangerment and resisting arrest, all Class 2 misdemeanors, according to online court records.

Jackson’s case has been stalled several months as he went through the state’s mental competency court process. Legal competency refers to a person’s ability to meaningfully and knowingly engage in their court case and legal proceedings and understand things like the court process and roles of those involved in criminal proceedings.
