The owner of a commercial property on Illinois Avenue in Maumee has sued the city to fight a city demand that the building there be brought up to current codes before any new tenant can move in. RPM Commercial LLC, of Bowling Green, contends that the city’s zoning-enforcement action violates its constitutional rights and, in particular, that the only reason a legal nonconforming use of the property was “abandoned” is that city officials have refused to grant a zoning permit for any successor to Landmark Pools and Spas after that business moved out in 2022. The city’s actions, the lawsuit filed last week in Lucas County Common Pleas Court states, “divest nonconforming owners of their protected rights by the passage of time alone” and have specifically deprived RPM “of its legal nonconforming use status without notice or an opportunity to be heard.” Alan Lehenbauer, Maumee’s law director, declined to comment Wednesday on the lawsuit’s merit…
