Albuquerque police arrest 13-year-old accused of killing man on bike

ALBUQUERQUE, N.M. (KRQE) – The Albuquerque Police Department arrested a 13-year-old who is accused of crashing a stolen car into a man who was riding his bike to work. Police identified the 13-year-old as Johnathan Overbay. Overbay was in the car with an 11-year-old and 15-year-old William Garcia who is also accused of participating in the crime that resulted in the death of 63-year-old Scott Dwight Habermehl.

In 2024, Habermehl was riding his bike to Sandia National Laboratory when he was hit by the car. Police said the kids recorded the crash as the driver intentionally swerved onto a dedicated bike lane. Overbay was charged with an open count of murder. Police are still searching for the other two juveniles.

APD said the 11-year-old was too young to be charged with murder but they were checking with the Bernalillo County District Attorney’s Office and New Mexico Children, Youth, and Families Department on what he could be charged with and whether he could be held…
