BOISE, Idaho (CBS2) — Local business owners are feeling confused and frustrated as they grapple with recent enforcement decisions by the Boise Police.
The businesses in question sell glass products, rolling papers, and smoke accessories, and have for years. These items are commonly used as drug paraphernalia, but local businesses tell CBS2 they have been selling them for legal tobacco use for years. Now, the Boise Police are telling them it’s illegal and they need to get rid of them or face enforcement actions.
The Idaho Statute that governs controlled substances and related paraphernalia is Title 31, Chapter 27, Article 1. The article clearly defines drug paraphernalia and provides a list of related objects, including chamber pipes, carburetor pipes, electric pipes, air-driven pipes, chillums, bongs, and many others.
